Unemployment benefits are rarely retroactive. Waiting even a couple of weeks to file means leaving money on the table when you need it most.

  • File on your state's Department of Labor site: Have your SSN, W-2/paystubs, employer address, and direct deposit details ready.
  • Severance usually does NOT disqualify you: In almost all states, you can collect benefits even while receiving severance. Some states may defer your first check, but filing immediately ensures your claim gets processed in the queue.
  • Weekly certifications and job logs: Most states require logging 2-3 job search activities per week (applications, networking calls, interviews). Keep a neat spreadsheet log.
  • Tax withholdings: Unemployment payments are taxable income! Elect to have 10-15% federal taxes automatically withheld to prevent a surprise tax bill next spring.

Health Insurance: COBRA vs. ACA Marketplace vs. Partner's Plan

Option 1

COBRA Continuation

Keep your exact existing employer health plan for up to 18 months.

  • The 90-Day Exercise Deadline: Most vested Stock Options (ISOs) expire 90 days after your termination date. Mark this date on your calendar immediately.
  • Underwater Options: If the exercise strike price is higher than the current fair market value, exercising makes no financial sense. Let them expire.
  • Restricted Stock Units (RSUs): Already-vested RSUs released to you are yours. Unvested RSUs are forfeited, but you can sometimes negotiate extending your termination date by a couple of weeks to hit an upcoming vesting milestone.
  • Alternative Minimum Tax (AMT) & CPA advice: Exercising ISOs can trigger heavy AMT tax liability. Always consult a tax professional before making large option exercises.

H-1B holders typically have a strict 60-consecutive-day grace period (or until your I-94 expires, whichever is shorter) to find a new sponsoring employer, submit a transfer petition, or change immigration status.

  • Confirm official termination date: Verify when your employer official revokes your visa sponsorship.
  • Consult an independent immigration attorney immediately: Do not rely solely on your former company's legal team.
  • Explore Change of Status (B-1/B-2): Filing a B-1/B-2 tourist visa change of status before the 60 days expire can grant extra legal processing time to continue interviewing.
